Texas Penal Code Chapter 20 defines a spectrum of offenses based on conduct and intent. Understanding where a charge falls on that spectrum is the first step in building a defense.

The foundation is the definition of restraint under Section 20.01: restricting a person’s movements without consent through force, intimidation, or deception, by either moving them or confining them. From that definition, the code builds three distinct offenses:

• Unlawful Restraint (Section 20.02): Knowingly or intentionally restraining another person. Generally a Class A misdemeanor, though it can rise to a state jail felony or third-degree felony depending on circumstances such as the victim’s age or the use of force.
• Kidnapping (Section 20.03): Requires abduction, meaning restraint with the specific intent to prevent liberation by secreting the victim where they’re unlikely to be found, or by using or threatening deadly force. A third-degree felony carrying 2 to 10 years in prison.
• Aggravated Kidnapping (Section 20.04): Abduction with additional intent elements, including holding the victim for ransom, using them as a hostage or shield, facilitating another felony, inflicting bodily injury or sexual abuse, terrorizing the victim, or using or exhibiting a deadly weapon. A first-degree felony carrying 5 to 99 years or life in prison. Voluntary safe-place release can reduce the offense to a second-degree felony with a range of 2 to 20 years.

Affirmative Defenses & Defense Strategies

Texas law provides a statutory affirmative defense to kidnapping under Section 20.03(b). It applies when the abduction was not coupled with intent to use or threaten deadly force, the defendant was a relative of the person abducted, and the defendant’s sole intent was to assume lawful control of the victim. This provision is most relevant in parental abduction situations involving custody disputes where no court order was violated and no force was threatened.

Beyond the statutory affirmative defense, effective kidnapping defense typically involves one or more of the following approaches:

• Intent Challenges: The state must prove intentional or knowing conduct and the specific abduction element beyond a reasonable doubt. Evidence that the alleged restraint lacked the required intent to prevent liberation can defeat the kidnapping charge even if some restraint occurred.
• Consent: If the alleged victim consented to accompany or remain with the defendant, the absence of non-consensual restraint undermines the state’s case at its foundation.
• Constitutional Violations: Evidence obtained through unlawful stops, searches, or interrogation may be suppressed, limiting what the prosecution can present at trial.
• Duress or Compulsion: When the defendant acted under a credible threat of force from a third party, duress may provide a general defense under Texas law.

Federal Kidnapping Exposure

A kidnapping case that begins in Bexar County can become a federal matter when specific triggers are present. Under 18 U.S.C. Section 1201, federal charges apply when the alleged offender transports the victim across state or international lines, uses any means of interstate commerce, commits the offense on federal land, or targets a federal official. The Western District of Texas, which covers San Antonio, is the federal jurisdiction for cases that meet these thresholds.

Federal kidnapping penalties are substantially more severe than their state counterparts. A conviction carries a potential sentence of life in prison. When the victim is under 18 and the defendant is not a parent, grandparent, sibling, aunt, uncle, or individual with legal custody, a minimum of 20 years applies. If the victim dies, the defendant may face the death penalty. Under 18 U.S.C.
